GENERAL RENTAL CONDITIONS

The service "Rental of equipment" is provided by Belle Bicyclette (hereinafter referred to as the
renter). The rental conditions are an integral part of the rental contract. By signing the contract,
the hirer confirms that he/she has read and accepted the rental conditions in full.

1. Taking over the equipment

The hirer takes over the equipment in good working order. The hirer is obliged to make any
complaint to the lessor at the time of taking over the equipment (inventory of fixtures). The lessor
reserves the right to assess the lessee's ability and aptitude to use an electrically assisted bicycle
within the framework of the rental service.
If the hirer does not inform the rental company of his or her lateness, the reservation will be
cancelled 1 hour after the scheduled rental time.

2. Return of the equipment

The hirer is obliged to return the equipment to the lessor at the end of the rental period defined in
the rental contract at the place of pick-up and during opening hours. The equipment and all
accessories provided by the lessor (helmets, etc.) must be returned to the lessor in perfect
condition. If the hirer has lost or damaged any accessories, these will be charged to him/her.
Material damage will be charged at the published rates.
For a morning rental, the rented equipment must be returned before 1 pm. For an afternoon or full
day rental, the rented equipment must be returned before 6 pm. Any late return will result in the
application of a fixed penalty equal to the rate of one day's rental per half-day or day of delay.

3. Cancellation and extension of the rental period

a) The client has the right to cancel his reservation under the following conditions:
More than 48 hours before the event: cancellation without reason and return to the hirer of the
amount received by the lessor.
Less than 48 hours before the service: as compensation the hirer keeps the whole amount
received.
In case of extreme weather conditions, we accept the postponement to a later date.
b) An extension of the rental contract is only possible with the consent of the lessor before the
end of the current rental contract. The lessor can refuse this extension without giving any reason.

4. Minimum age of the hirer

The hirer must be of age.
The minimum age to use an electric bicycle is 14 years and/or 1.55m minimum.

5. Services and prices

The valid prices are those published by the renter and in his brochures.

6. Insurance, Warranty

Insurance is the responsibility of the hirer. By signing the rental agreement, the hirer confirms that
he/she has adequately covered the risks associated with the use of the equipment.
The breakage/theft guarantee is included in your rental, in which case you are protected against
breakage, whether partial or total, theft by assault, burglary or when the bicycle is attached to a
fixed point. A deductible of 10% of the repair bill with a minimum of 10 € will remain at your
charge in case of breakage and a deductible of 10% of the value of the cycle will remain at your
charge in case of irreparable breakage or theft. For more details, please refer to the details of the

7. Helmets

An approved helmet is provided free of charge.

8. Responsibility of the hirer

The hirer certifies that he/she is fit to use the rented equipment and that he/she has no medical
contraindications.
The hirer undertakes to use the rented equipment with care, without danger to third parties and in
accordance with the instructions for use. The hirer is always responsible for the physical and
material damages he causes during the use of the rented equipment (art.1383 and 1384 of the

civil code). Belle Bicyclette will not be held responsible for any damage or loss suffered or caused
by the hirer during the use of the rented equipment. The use in competition or for a driving similar
to a competition is forbidden. In the event of accidental damage, loss, theft or improper handling
of the equipment, the lessee shall be liable for the costs of repair. In case of total damage or loss,
the lessee is responsible for the replacement value of the equipment.

9. Instructions for use

The hirer undertakes to use the equipment himself/herself and to use it with due care.
The hirer declares that he/she will abide by the rules of the Highway Code. If the hirer
contravenes the laws and regulations in force during the rental period, the lessor cannot be held
responsible.
The renter is strongly advised to wear a helmet (compulsory for children under 12 years old).
The hirer undertakes to do everything possible to avoid theft or damage to the rented goods. To
this end, regardless of the length of time the bicycle is parked, he/she undertakes to attach it to a
fixed point using the anti-theft device provided.
The use of the luggage rack is strictly limited to carrying objects not exceeding 25 kg in weight.
Under no circumstances may it be used to
to transport a person.
The baby seat is reserved for children aged 1 to 5 years whose weight is less than 22 kg. The
baby must be properly strapped in using the belts provided.
The child trailer is limited to the transport of 2 children under 6 years of age for a total weight not
exceeding 40 kg. The hirer is not allowed to exceed 13km/h with a trailer.
The Follow Me system allows you to create a tandem with a second bike. It is reserved for
children from 4 to 9 years old and less than 1m35 tall.
The hirer is informed at his departure about the autonomy of the battery. In case of exhaustion of
this one, the hirer is not held for person in charge. The user may not use any charger other than
the one provided by the lessor.
The hirer is forbidden to use paths that are not covered by a body or reserved for mountain
bikes.
In case of technical failure of the bike, during the contract, it is up to the hirer to inform the rental
company without delay at the following number: +33(0)7 88 66 96 35.
The hirer may not undertake any repair work on his own initiative. Only the lessor is able to judge
whether a repair is a matter of maintenance and therefore at the expense of the lessor or whether
the repair is due to damage to the equipment during the rental period, and therefore at the
expense of the lessee.

10. Deposit of guarantee

The lessor requires a credit card imprint or an identity document as a guarantee against loss,
theft or damage of the equipment. The lessee authorizes the lessor to deduct from the security
deposit the amounts due:
– Under the deductible, to repair damage and theft whose rates are displayed at the rental point.
– Under the compensation for late return of the rented equipment.
It is expressly agreed that the amount of the deposit does not constitute a guarantee limit.

11. Applicable law

This contract is subject to French law. In case of dispute, in order to confront the points of view of
the third parties and to allow them to find a solution to the dispute themselves, a mediator may be
appointed by the parties or the judge previously seized. This mediation may then take two
possible forms: conventional or judicial. In case of mediation in the first place and of non
resolution of the dispute, the competent court by default would be that of the lessor.
